If you don't pass, we'll refund you in full.

1. The short version

If you bought the 6-Month Full Access plan, used the app for at least 20 hours of mock oral exam time during your access window, took the ABA Standardized Oral Examination during that window, and did not pass, you can request a full refund of your purchase price within 90 days of receiving your fail notification.

The detailed terms are below. The detailed terms control if there is any inconsistency between this summary and the rest of this page.

2. Who's eligible

You qualify only if all of the following are true:

1. You purchased a 6-Month Full Access plan ("the Plan") through the Anesthesia Boards iOS app (the "App"). The 3-Month Full Access plan is not covered by this guarantee.
2. You logged at least 20.0 hours of active mock oral exam time in the App during the Plan's access window. "Active mock oral exam time" means time recorded by the App during exam sessions you started yourself; tutorial walkthrough time does not count. The App's recorded time is the sole measure for this requirement.
3. You took the ABA Standardized Oral Examination ("the Exam") during the Plan's access window or within 30 days after the window ended.
4. You did not pass the Exam, as evidenced by the official score report from the American Board of Anesthesiology ("the ABA") sent to your email of record.
5. You are a resident of the United States at the time of purchase and at the time of claim.
6. You are claiming this guarantee for the first time. One refund per person, ever.
7. The Pass Guarantee was offered to you at the time of your purchase. We may turn off the Pass Guarantee for new purchases at any time; if you bought your Plan while the guarantee was offered, you remain eligible per the terms in effect at the time of your purchase.

3. How to claim

Submit your claim within 90 days of receiving your ABA fail notification:

1. Email support@medoralboards.com with the subject line "Pass Guarantee Claim".
2. Forward (do not screenshot) the original email from the ABA containing your score report. Forwarding preserves the email headers we need to verify the message came from noreply@theaba.org.
3. Include the Apple ID email address used to purchase the Plan, and your full name as it appears on the ABA score report.
4. We will verify your eligibility (the App's exam-time records, your purchase, the ABA score report) and reply within 14 business days with either an approval or a written explanation of why your claim was denied.

4. How the refund is paid

Apple operates the in-app purchase system on iOS. We do not directly process Apple's billing. When we approve your claim:

1. We will first ask you to request a refund directly from Apple at reportaproblem.apple.com. Apple may or may not grant the request — we have no control over Apple's decision. If Apple grants the refund, your access ends immediately and you are paid the full purchase price by Apple.
2. If Apple denies the refund (which is common for purchases more than 90 days old), we will pay you the full purchase price you originally paid through PayPal, Stripe, or another payment method you choose, within 14 business days of Apple's denial. We will also revoke your in-app access at that time.

Either way, you receive the full price you paid. We absorb any fees Apple kept from the original purchase.

5. Definitions

Active mock oral exam time

The time recorded by the App from the moment you start a mock oral exam (by tapping "Start Exam" or equivalent) until that exam ends or you exit the exam screen. Time spent on the dashboard, in settings, in history, or in the first-run tutorial walkthrough does not count.

Access window

The 6-month period beginning at the moment you completed your purchase of the 6-Month Full Access plan, as recorded by Apple's billing system and our entitlements ledger.

The Exam

The ABA Standardized Oral Examination administered by the American Board of Anesthesiology. This guarantee does not cover BASIC, ADVANCED, OSCE, or any other ABA-administered examination, and does not cover examinations administered by any other certifying body (e.g., AOA, NBME).

"Did not pass"

Receiving a final result of "Not Pass" from the ABA on the Exam. Conditions, retakes, scheduling delays, withdrawals, no-shows, or administrative cancellations are not covered.

6. Limitations

• One refund per person, ever, regardless of how many times you purchase.
• The guarantee cannot be combined with promotional pricing, discount codes, group purchases, refunded purchases, or purchases made through any channel other than the Anesthesia Boards iOS app.
• We may decline a claim if we determine, in good faith and on reasonable grounds, that the claim is fraudulent — for example, if the score report cannot be verified as authentic, if the exam-time records appear to have been generated by automation, or if the claimant is not the person who purchased the Plan.
• The App's recorded exam time is the sole measure of usage. We will not accept other evidence (screenshots, third-party time trackers, attestations, etc.) in lieu of the App's records.
• This guarantee does not affect any other rights you have under applicable consumer protection law, including any non-waivable rights you have under the laws of your state of residence.

7. Disclaimers

We don't guarantee that you will pass the Exam if you use the App. The Exam outcome depends on many factors outside our control — your medical training, your study habits, the specific case material on the Exam day, examiner judgment, and your performance under stress.

This Pass Guarantee is a refund commitment, not a promise of passing.

8. Governing law and venue

This Pass Guarantee is governed by the laws of the State of {{STATE}}, without regard to its conflict-of-law principles. Any dispute arising from this Pass Guarantee shall be resolved exclusively in the state or federal courts located in {{COUNTY}}, {{STATE}}, and you consent to the personal jurisdiction of those courts.

Nothing in this section limits any non-waivable rights you have under the consumer protection laws of your state of residence.

9. Changes to this policy

We may update or discontinue this Pass Guarantee for future purchases at any time. If you purchased the Plan while the Pass Guarantee was offered, the version of this policy in effect at the time of your purchase will continue to apply to your purchase.
